These Terms of Service govern your use of Spontaneous Works' SMS alert services for Disney World restaurant reservations.
1. Acceptance of Terms
By signing up for our SMS alert service, creating an account, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
2. Service Description
Spontaneous Works provides SMS text message alerts to notify users when Disney World restaurant reservations become available based on their specified preferences including:
- Restaurant selection
- Preferred dining dates and times
- Party size preferences
- Real-time availability notifications
Important: We are not affiliated with, endorsed by, or connected to The Walt Disney Company or Disney Parks. We are an independent third-party service that monitors publicly available reservation information.
3. SMS Marketing Terms
3.1 Consent and Opt-In
- By providing your mobile phone number and checking the SMS consent box, you expressly consent to receive automated marketing text messages from Spontaneous Works
- Consent is not a condition of purchase or use of any goods or services
- Message frequency varies based on reservation availability but may be up to 10 messages per month
- Message and data rates may apply according to your cellular plan
3.2 Opt-Out Instructions
You may opt out of receiving SMS messages at any time by:
- Replying with any of these keywords: STOP, QUIT, END, CANCEL, UNSUBSCRIBE, OPT OUT, or REVOKE
- Contacting us at support@spontaneousworks.io
- Using the unsubscribe link in your account settings
We will process your opt-out request within 10 business days as required by TCPA regulations effective April 2025.

4. Eligibility and Age Requirements
- You must be at least 18 years old to use our SMS services
- You must provide accurate and current information during registration
- You must be the authorized user of the mobile phone number provided
- Our services are only available to users in the United States
5. User Responsibilities
You agree to:
- Provide accurate, current, and complete information when registering
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Use our services only for lawful purposes
- Not attempt to circumvent, disable, or interfere with our services
- Make your own Disney restaurant reservations through official Disney channels
6. Service Availability and Accuracy
6.1 No Guarantee of Availability
- We provide notifications on a "best effort" basis
- We cannot guarantee that all available reservations will be detected
- Disney reservation availability changes rapidly and reservations may be filled before you can book
- Service interruptions may occur due to technical issues, maintenance, or third-party limitations
6.2 No Booking Service
We do not make reservations on your behalf. You must book reservations directly through official Disney channels including:
- My Disney Experience app
- DisneyWorld.com
- Disney customer service phone lines
7. Fees and Payment
- Our basic SMS alert service is currently provided free of charge
- Standard message and data rates from your mobile carrier may apply
- We reserve the right to introduce premium features with associated fees in the future
- Any future paid services will require separate consent and payment terms

9. Disclaimers and Limitations of Liability
9.1 Service Disclaimers
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPONTANEOUS WORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Missed dining reservations or opportunities
- Travel expenses or changes to vacation plans
- Loss of time or convenience
- Service interruptions or delays
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO OUR SERVICES SHALL NOT EXCEED $100.
10. Intellectual Property
- Our service, content, and technology are protected by intellectual property laws
- You may not copy, modify, distribute, or reverse engineer our services
- "Disney," "Walt Disney World," and related marks are trademarks of The Walt Disney Company
- We use these terms solely for descriptive purposes and claim no ownership or affiliation
11. Termination
11.1 Termination by You
You may terminate your use of our services at any time by opting out of SMS messages or contacting support.
11.2 Termination by Us
We may suspend or terminate your access to our services if you:
- Violate these Terms of Service
- Provide false or misleading information
- Engage in abusive or fraudulent behavior
- Use our services in ways that could harm our systems or other users
12. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via:
- SMS notification to active users
- Email notification
- Posted notice on our website
Continued use of our services after changes constitutes acceptance of the new Terms.
13. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the United States and the state where Spontaneous Works is incorporated
- Any disputes shall be resolved through binding arbitration rather than court proceedings
- The arbitration will be conducted by a single arbitrator in accordance with commercial arbitration rules
- You waive any right to participate in class action lawsuits or class-wide arbitrations
